By accessing the savaniswiss.com website or engaging Savani Swiss SA in any commercial capacity, you agree to the following terms. These terms apply to all visitors, registered partners, and trade clients alike.

2.1 Acceptance of Terms

Your continued use of our website, atelier services, or trade desk constitutes acceptance of these terms. We may amend them at any time with reasonable notice — material changes are highlighted via the version stamp at the top of this page.

2.2 Permitted Use

The Savani Swiss website is provided for informational and trade enquiry purposes. You may not:

• Reproduce, redistribute, or modify any content without our prior written consent
• Use automated scraping tools, bots, or rate-abusive requests against our servers
• Misrepresent your identity, trade credentials, or beneficial ownership
• Use the site to facilitate illegal activity of any nature

2.3 Inventory & Pricing

All inventory displayed on this website is indicative. Availability, pricing, and certification status are confirmed only upon written quotation from our trade desk. We reserve the right to withdraw any stone from sale before the issuance of a formal invoice.

2.4 Limitation of Liability

Information on this website is provided "as is". To the maximum extent permitted by Swiss law, Savani Swiss disclaims liability for indirect, incidental, or consequential losses arising from reliance on website content. Our liability in connection with any direct contract is limited to the invoice value of the parcel concerned.

2.5 Governing Law

These terms are governed by the substantive laws of Switzerland. Disputes shall be submitted exclusively to the ordinary courts of the Canton of Geneva, subject to appeal to the Swiss Federal Tribunal.

Savani Swiss uses a deliberately minimal set of cookies. We do not deploy advertising cookies, behavioural tracking, or third-party social pixels. Our use of cookies is governed by Swiss FADP and the EU ePrivacy Directive.

3.1 Essential Cookies

Always active. These cookies are required for the website to function — for example, to remember your language preference, manage your appointment booking session, or maintain secure form submissions. They cannot be disabled.

3.2 Analytics Cookies

Opt-in. We use a self-hosted, anonymised analytics tool (Plausible) to understand which pages our visitors value most. No personally identifiable data is collected, and no information is shared with third parties.

3.3 Preference Cookies

Opt-in. If you register as a trade partner, we may store your saved searches and inventory preferences in encrypted cookies for a maximum of ninety days. You may clear these at any time via your account settings.

Under the EU General Data Protection Regulation (and equivalent provisions of the Swiss Federal Act on Data Protection), individuals whose data we process hold the following rights:

4.1 Right to Access

You may request a complete copy of all personal data we hold about you. We will respond within 30 calendar days, free of charge for the first request in any 12-month period.

4.2 Right to Rectification

You may request correction of any inaccurate or incomplete personal data we hold. Corrections are typically completed within 7 business days.

4.3 Right to Erasure

Also known as the "right to be forgotten". You may request deletion of your personal data, subject to overriding legal obligations (such as 10-year retention of transaction records under Swiss commercial law).

4.4 Right to Restrict Processing

You may request that we limit how we use your data while a dispute or correction is being resolved.

4.5 Right to Data Portability

You may receive your personal data in a structured, commonly used, machine-readable format (JSON or CSV), and have the right to transmit that data to another controller.

4.6 Right to Object

You may object to processing of your data for direct marketing at any time. Such processing will cease immediately upon objection.

4.7 Right to Lodge a Complaint

You retain the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, if you are an EU resident, with your national data protection authority.

The following conditions govern all commercial transactions between Savani Swiss SA and verified trade partners (jewellery houses, ateliers, dealers, and licensed intermediaries). They are referenced in every memo, invoice, and consignment receipt we issue.

5.1 Partner Verification

Trade access is granted only upon successful completion of our KYC and AML review (see Section VII). Verified partners receive a unique trade code valid for two years, renewable upon re-verification.

5.2 Memo Terms

Diamonds delivered on memo remain the property of Savani Swiss until full payment is received. Standard memo periods are 14 days from delivery. Extensions require written approval. Loss, damage, or unauthorised modification of memo stones triggers full invoice liability.

5.3 Payment Terms

Invoices are payable net 30 days from issue date in CHF, EUR, or USD by SWIFT transfer to our verified bank account. Late payments incur interest at 5% per annum compounded monthly, in accordance with Swiss commercial practice.

5.4 Insurance & Risk

All shipments are insured by Lloyd's of London under our open marine cargo policy. Risk transfers to the buyer upon signed receipt at the agreed delivery point (typically the buyer's premises or designated vault).

5.5 Returns & Disputes

Quality disputes must be raised in writing within 7 calendar days of delivery and accompanied by independent lab review (GIA, IGI or HRD). Returns of unmodified, fully-papered stones are accepted within 30 days for outright sales — subject to a 5% restocking fee.

Savani Swiss SA has been a fully accredited participant of the Kimberley Process Certification Scheme (KPCS) since its inception. This is not a marketing position — it is a binding international obligation that governs every rough diamond entering our laboratory.

6.1 Our Pledge

In line with World Diamond Council guidelines and the System of Warranties, every Savani Swiss invoice carries the following declaration:

6.2 Documentation Trail

Each rough we acquire is accompanied by a Kimberley Process Certificate issued by the exporting country's designated authority. These certificates are archived for a minimum of five years and made available to verified buyers upon request.

6.3 Our Refusals

We have, and will continue to, refuse parcels offered to us if:

• The Kimberley certificate cannot be cross-verified with the exporting authority
• The chain of custody contains unverifiable intermediaries
• The parcel originates from a jurisdiction under active KP suspension
• Our independent gemmological inspection reveals inconsistencies with the producer's specifications

6.4 Beyond Kimberley

We additionally adhere to the standards of the Responsible Jewellery Council (RJC) and the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas. Compliance audits are conducted annually by an independent third party.

Savani Swiss SA is bound by the Swiss Anti-Money Laundering Act (AMLA) and the regulations of FINMA (Swiss Financial Market Supervisory Authority). We apply rigorous Know Your Customer (KYC) procedures to every trade partner.

7.1 Customer Due Diligence

Before any first transaction, prospective partners must provide:

• Corporate registration and beneficial ownership documents (UBO disclosure)
• Trade licence and tax identification numbers
• Signed self-declaration of source of funds
• Identification of all signatories holding 25% or greater beneficial interest

7.2 Enhanced Due Diligence

For transactions exceeding CHF 100,000, or for partners domiciled in higher-risk jurisdictions per FATF guidance, we apply enhanced verification — including source-of-wealth documentation and senior compliance sign-off.

7.3 Sanctions Screening

All partners and beneficial owners are screened against the consolidated SECO sanctions list (Switzerland), EU restrictive measures, and OFAC lists (United States) prior to onboarding and at every renewal.

7.4 Suspicious Activity Reporting

Where required by law, we report suspicious transactions to the Money Laundering Reporting Office Switzerland (MROS) without notifying the affected party — as Swiss law mandates.

The Savani Swiss name, the encircled diamond mark, the typographic logo, and all website content are protected by Swiss, EU, and international intellectual property law.

8.1 Trademarks

"SAVANI SWISS", "Savani · Swiss" (with diamond emblem), and the phrase "Where Quality Meets Precision and Luxury" are registered trademarks of Savani Swiss SA under WIPO classification and the Swiss Federal Institute of Intellectual Property (IGE).

8.2 Copyright

All photographs, illustrations, written content, video, code, and design elements appearing on this website are the property of Savani Swiss SA or our licensed contributors. Reproduction in any form requires written authorisation.

8.3 Permitted Reference

Trade partners may use our name and emblem in invoicing, certification, and marketing materials to identify the provenance of Savani Swiss diamonds — provided the use is accurate, contextual, and not misleading as to endorsement.

8.4 Enforcement

Unauthorised use of our trademarks or content — whether on websites, in print, or in commerce — is actively monitored and pursued. Where infringement is identified, we proceed under Swiss IP law and applicable international treaties.
